Terms of Service

By accessing or using this website (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

These Terms apply to visitors and people who submit inquiries through the Site. They do not by themselves create a client engagement. Paid work is governed by a separate written agreement and statement of work between you and After 5 LLC ("After 5," "we," "us," or "our").

After 5 LLC is a small-business studio. We offer services such as custom websites, logo and brand identity, SEO, graphic design, domain transfer support, Shopify setup or integration, and business card design. Descriptions of services, timelines, and pricing ranges on the Site are general information only.

You may use the Site for lawful purposes: learning about our work, browsing selected projects, and submitting a quote or contact request.

You agree not to:

• Use the Site in any way that violates applicable law
• Attempt to probe, scan, disrupt, or gain unauthorized access to the Site, related systems, or other users' data
• Scrape, harvest, or automate access to the Site in a way that overloads or interferes with it, except for ordinary search-engine indexing
• Misrepresent your identity or affiliation when contacting us
• Upload or transmit malware or other harmful code through any form or channel connected to the Site

We may suspend or restrict access to the Site at any time, including for maintenance, security, or misuse.

Submitting a brief, quote request, or other message through the Site is an invitation for us to respond. It does not:

• Form a binding contract for services
• Guarantee availability, pricing, timeline, or that we will take the project
• Create a confidential relationship by itself (if you need confidentiality before sharing sensitive material, ask for an NDA)

Any estimate we provide is informal until confirmed in a signed agreement and statement of work. Scope, fees, ownership of deliverables, and payment terms are set only in that written engagement paperwork.

Unless otherwise noted, the Site's design, text, graphics, logos, layout, and other content are owned by After 5 LLC or used with permission. You may view and share links to public pages for personal or ordinary business evaluation. You may not copy, republish, sell, or create derivative works from Site content for commercial use without our prior written consent.

Client work shown in "selected work" or case studies remains subject to the rights we and the client agreed in that engagement. Appearance on the Site does not grant you a license to reuse those designs, code, photos, or marks.

The Site may link to third-party websites, platforms, or tools (for example, client storefronts or social embeds). We do not control those properties and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTER 5 LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that content (including timelines, price ranges, or portfolio descriptions) is complete or current.

Nothing on the Site is legal, tax, or professional advice for your business.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTER 5 LLC AND ITS OWNERS, OFFICERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed by law.

Note: Limits for paid client work belong in your client agreement, not only here.

You agree to defend, indemnify, and hold harmless After 5 LLC and its owners, officers, contractors, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of someone else's rights in connection with Site use.

Our collection and use of personal information through the Site is described in our Privacy Policy. By using the Site, you acknowledge that policy.

We may update these Terms by posting a revised version on the Site and updating the "Last updated" date. Continued use after changes means you accept the updated Terms. For material changes, we may also note the update on the Site.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.

Exclusive venue for disputes arising out of these Terms or the Site will be the state or federal courts located in Gwinnett County, Georgia, and you consent to personal jurisdiction there.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding Site use and supersede prior understandings on that subject only. They do not alter signed client contracts.

You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or similar transaction.
